Buying or selling property involves more than signing an agreement. The title, the parties’ authority, financing, conditions and completion documents all need to work together.
We assist purchasers, vendors and property owners with sale and purchase agreements, title-related enquiries, consent applications, transfer documentation and completion arrangements. Where an estate is involved, we also examine the representative’s authority and any required court permission. We explain the outstanding steps so you know what must happen before money, possession or ownership changes hands.
We acted for vendors on a residential sale, handling completion funds, vacant-possession arrangements and apportionment of outgoings. The work included coordinating release of keys and disbursement of the balance purchase price according to instructions.
We advised purchasers on a proposed residential acquisition involving an estate administrator. Our draft agreement addressed title issues, court-approval conditions, stakeholder arrangements and contractual protection for deposits and completion. This work concerned preparation and review before execution.
We represented a vendor in a leasehold residential sale involving applications for consent to transfer and charge. The application brought together the title search, sale agreement, court order and financing information needed for the land-office process.
We handled strata-title perfection work for an apartment owner, including official-search documentation and preparation of the certified-title handover. This illustrates the further documentation that may be needed after the original purchase arrangements.
These anonymised examples describe particular stages of work undertaken. An application or draft agreement should not be read as confirmation that every approval or transfer has been completed.
Before committing: we review proposed terms, the title or existing purchase documents, the seller’s authority and any restrictions, charges or caveats. These checks help identify the conditions and documents the agreement should address.
During the transaction: we coordinate the agreed documentation and relevant consent, redemption or financing steps. Individual titles, strata titles and properties without separate titles may require different procedures. Consent requirements depend on the title and applicable rules, not simply whether a property is leasehold.
Towards completion: we address the agreed payment and possession arrangements, stamping, applicable Real Property Gains Tax reporting and retention requirements, and registration steps. Tax exemptions and reliefs depend on their conditions.
There is no single completion period for every transaction. Timing depends on the agreement, financing, approvals and outstanding title or estate issues. State procedures differ, and Sabah and Sarawak have separate land laws.
We establish your role, the property, proposed terms, financing position and any deadlines.
We review the available documents, title information, restrictions and conditions requiring attention.
We prepare or review the agreed documents and coordinate the relevant approvals and completion requirements.
We progress the agreed payment, possession and registration steps, subject to the documents and conditions being satisfied.
Have the title or previous sale agreement, booking or offer documents, proposed price and terms, financing information and relevant correspondence ready. If an owner has died, include the grant and existing court or distribution orders. Tell us about any caveat, outstanding loan, tenancy or approaching deadline.
Seek advice before signing documents or agreeing to release funds. Start with a brief enquiry so we can arrange an appropriate channel for confidential material.
